Regulations on the Telecommunications and Infocommunication Operators Board 
of the Regional Commonwealth in the Field of Communications

1.General Regulations

1.1. The Telecommunication and Infocommunication Operators Board of the Regional Commonwealth in the Field of Communications (hereinafter referred to as “RCC TIOB”) was established on the basis of the Decision of the RCC Board of the Communications Administrations Heads №17/3 of June 5, 1997 and in accordance with the RCC Charter.

1.2. The RCC TIOB is a working body of the Regional Commonwealth in the Field of Communications and is accountable in its activities to the RCC Board of the CAs Heads.

1.3. The RCC TIOB is guided in its activities by the RCC Charter, decisions of the RCC Board of the CAs Heads, these Regulations and the Rules of the RCC TIOB.

1.4. The RCC TIOB considers the development and operational activities in the field of information communications and makes decisions on them, if necessary, submits material for consideration at the RCC Board of the CAs Heads. In its work, the RCC TIOB works closely with the RCC Board of the CAs Heads, the RCC working bodies and the RCC Executive Committee.

1.5. The RCC TIOB may form in its composition Working Groups on various types of activities in the field of infocommunications. The Working Group carries out its activities in accordance with the RCC Charter and these Regulations and is formed on the proposals and recommendations of the participants of the RCC TIOB, endowed with rights on issues related to the scope of the Working Group.

1.6. The RCC TIOB makes decisions:

- recommendatory nature on issues of info-communications;

- of a binding nature regarding the functioning of the RCC TIOB and its Working Groups.

The decisions taken must not contradict the legislation of the states in which the participants of the RCC TIOB carry out their operator functions, and must take into account the legal acts of international organizations regarding infocommunications.

1.7. The RCC TIOB may delegate its representatives to other RCC Working Bodies with an advisory vote, prepare materials and determine speakers for the RCC Board of the CAs Heads on issues within the competence of the RCC TIOB.

1.8. The operating procedure of the RCC TIOB is regulated by the Rules of the RCC TIOB. The Rules of Procedure of the RCC TIOB are developed taking into account the RCC Charter, the Rules of Procedures of the RCC Board of the CAs Heads, as well as these Regulations and are approved by the RCC TIOB.

2.Tasks of the RCC Telecommunications and Infocommunication Operators Board

2.1. Coordination of the operation and development of primary communication networks, networks and automated telephone services, networks and documentary services, data networks, distribution systems for sound and television broadcasting programs, mobile networks.

2.2. Discussion of the development of intelligent communication networks, wireless data networks, the introduction of modern information and communication technologies.

2.3. Interaction on the development of technical means of infocommunications.

2.4. Interaction on issues of operational and technical management of communication networks in interstate directions, including in emergency situations.

2.5. Optimization of commercial and technical conditions of interaction between operators. Improving the principles and discipline of mutual settlements between operators for the provision of services.

2.6. Exchange of experience on the formation of tariff policy.

2.7. Interaction of operators in the field of ensuring information security of interacting communication networks.

2.8. Coordination of work on the quality management of communication services
in accordance with the requirements of the market for services and users.

2.9. Organization of joint development and submission to the RCC Board of the CAs Heads for consideration of proposals for improving existing and creating new regulatory documents on the technical operation of communications and on the operational and technical management of communications networks in interstate directions.

2.10. Interaction in solving systemic network issues.

2.11. Interaction on the development and implementation of new types of international services.

2.12. Interaction on issues of training, retraining and advanced training of personnel.

2.13. Organization of conducting research projects of mutual interest and funded jointly to develop concepts, guidelines and guiding technical documents that ensure mutually beneficial development and use of communication networks and services in the RCC Telecommunications Space.

2.14. Coordination of the main activities of the RCC TIOB and its Working Groups.

2.15. Participation in the preparation and discussion of issues at meetings of the RCC Board of the CAs Heads.

2.16. Elaboration of coordinated positions of the participants of the RCC TIOB on information communication issues considered by international organizations.

2.17. Periodic informing the RCC Board of the CAs Heads about the work of the RCC TIOB.

2.18. Regular exchange of information on regulatory documents on ICT implemented on infocommunications networks, indicating the possibility of their acquisition and distribution on the operator’s network.

2.19. Promoting the introduction of new infocommunications technologies and services, expanding the interaction of participants in the market of infocommunications services.

2.20. Taking part in the development of existing development concepts and promising communication networks, the market of infocommunications services.

2.21. Participation in the discussion of the organization of the release of the radio frequency spectrum for the deployment of promising communication networks and the introduction of new radio technologies.

2.22. Interaction on the preparation of proposals to improve the use of the radio frequency spectrum and other limited resources in the field of infocommunications.

2.23. Participation in the development of recommendations on the principles and forms of mutual settlements between telecommunication operators and other organizations operating in the field of infocommunications.

2.24. Organization of work on information and methodological support for the activities of RCC members in the field of development of infocommunications, including preparation for participation in international events.

2.25. Participation in exhibitions, seminars, conferences, symposia, meetings and other scientific and informational events dedicated to the issues of infocommunications.

2.26. Interaction with international associations and organizations on the development of infocommunications.

3.Membership in the RCC Telecommunications and Infocommunication Operators Board

3.1. Voluntarily, participants in the RCC ESI RCC can be telecommunication operators with the right to provide infocommunications services on national and/or international telecommunication networks, their holding companies and associations, as well as equipment manufacturers, software developers and other organizations operating in the field of infocommunications.

3.2. The admission of candidates, communication administrations, which are participants of the RCC, to the RCC TIOB is carried out by the RCC Board of the CAs Heads on the recommendation of the corresponding RCC CA based on a candidate’s application with prior approval of the RCC TIOB.

The admission of candidates who are observers or associate members of the RCC to the RCC TIOB is carried out on a voluntary basis upon their request.

The acceptance of candidates, communications administrators who are not RCC members in the RCC TIOB is carried out according to their statements by the decision of the RCC Board of the CAs Heads with preliminary approval of the RCC TIOB.

3.3. The Member of the RCC TIOB must:

- comply with the requirements of these Regulations;

- take an active part in the work of the RCC TIOB and the Working Groups;

- Respect the rights and legitimate interests of the participants of the RCC TIOB;

- maintain the authority and unity of the RCC TIOB;

- timely pay membership dues.

3.4. Participants of the RCC TIOB can have the status of a full member, observer or associate member. Only telecommunication operators can be full members of the Board and have a casting vote when the Board makes decisions. The Board observers have only deliberative voting power when the Board makes decisions. Associates are without the right to vote, they have the right to familiarize themselves with the materials of meetings, decisions and documents adopted, and also, by the decision of the Council, make reports and participate in the discussion of certain issues on the agenda.

3.5. The participants of the RCC TIOB, communications administrations, which are full members of the RCC, may be full members of the RCC TIOB or observers.

The choice of status is carried out by the organization that has expressed a desire to become a participant, taking into account the provisions of paragraph 3.4 of these Regulations RCC TIOB, and agreed with the Communications Administration recommending a candidate for the composition of the RCC TIOB.

Participants of the RCC TIOB, communications administrations, which are RCC observers, maybe observers of the RCC TIOB.

Organizations that are observers or associate members of the RCC may be observers of the RCC TIOB.

Participants of the RCC TIOB, whose communications administrations are not part of the RCC, may be observers of the RCC TIOB.

3.6. A full member of the RCC TIOB has the right:

- to participate in the discussion and resolution of all issues of the functioning of the RCC TIOB;

- to propose candidates, to elect and be elected to the leadership of the RCC TIOB and its Working Groups;

- to make suggestions on the formation of the agenda of meetings of the RCC TIOB, its Working Groups and to make messages/reports to them.

Members of the RCC TIOB, whose communications administrations are not part of the RCC, may be observers of the RCC TIOB.

3.7. An observer in the RCC TIOB is entitled to:

- participate in the discussion of the functioning of the RCC TIOB;

- to make suggestions on the formation of the agenda of meetings of the RCC TIOB, its Working Groups and to make messages/reports on them;

- participate in the work of the Working Groups RCC TIOB.

3.8. Any member of the RCC TIOB may withdraw from the RCC TIOB by sending a notification to the RCC Executive Committee.

Upon receipt of such notification, the RCC Executive Committee on behalf of the Chairman of the RCC TIOB informs all members of the RCC TIOB about this. The decision to withdraw from RCC TIOB will enter into force after the member who has announced the withdrawal from the RCC TIOB has settled all his obligations related to his membership in the work of the RCC TIOB and the approval by the Board of his withdrawal from the RCC TIOB.

3.9. In the event that a member does not fulfill his obligations to the RCC TIOB, the Board is entitled to apply for assistance to the Communications Administration that recommended the organization of the RCC TIOB.

3.10. If a member of the RCC TIOB violates his obligations set forth in these Regulations, then the question is raised about the suspension of his membership or his exclusion from the list of members of the RCC TIOB. The Board, by its decision, may suspend the membership of the participant for a period of up to two years, determined for the settlement of all unfulfilled obligations properly. In case of non-settlement of unfulfilled obligations within the specified time period, the Board shall consider the question of exclusion of a participant from the composition of the RCC TIOB.

3.11. Membership in the RCC TIOB is not an obstacle to entry into other communities, unions, associations, as well as joining other agreements.

4.Organization of the work of the RCC Telecommunications and Infocommunication Operators Board

4.1.      Meetings of the RCC TIOB are held as necessary, but at least once a year.

4.2.      The work of the Operators Board is headed by The Chairman of the RCC TIOB and his deputy/deputies nominated from full members of the RCC TIOB and approved by the RCC Board of the CAs Heads for a period of three years.

The functions of the Chairman of the RCC TIOB and his deputies are performed by the organizations' heads from among the full members of the Operators Board.

If the Chairman of the RCC TIOB for some reason cannot continue to perform his duties, his functions are performed by one of the Vice-Chairmen of the RCC TIOB until the next elections are held.

4.3.      The duties of the Chairman of the RCC TIOB include:

-resolution of issues related to the functioning of the RCC TIOB;
-preparation and consideration of proposals for discussion at meetings of the RCC TIOB and the RCC Board of the CAs Heads;
-resolving issues related to participation in the RCC TIOB, developing internal rules, preparing work programs and reports on the activities of the RCC TIOB;
-approval of documents accepted by the RCC TIOB;
-formation of Working groups for the implementation of decisions of RCC TIOB;
-representation on behalf of the RCC TIOB in the RCC Board of the CAs Heads, RCC Working bodies and other organizations;
-distribution of responsibilities among their deputies;
-interaction with the RCC Executive Committee on the functioning of the RCC TIOB;
-representation on behalf of the RCC TIOB in the RCC Board of the CAs Heads, RCC Working bodies and other organizations;
-distribution of responsibilities among their deputies;
-interaction with the RCC Executive Committee on the functioning of the RCC TIOB.

4.4. The working groups of the RCC TIOB meet as necessary. Their work is headed by the Chairman of the Working Group, who is elected at a meeting of the Working Group from among full members for a period of three years and is approved by the RCC TIOB.

4.5. The duties of the Chairman of the Working Group include: holding meetings, approving the adopted documents, representing the Working Group on behalf of the Working Group in the RCC TIOB and the RCC Board of the CAs Heads, submitting proposals developed by the Working Group for approval by the RCC TIOB informing the RCC Working Bodies about the work being done.

4.6. The current work of the RCC TIOB and its Working Groups is carried out, as a rule, by correspondence, final decisions are made at meetings of the RCC TIOB.

4.7. The RCC Executive Committee carries out organizational work and ensures interaction between members of the RCC TIOB and its Working Groups, with the RCC Board of the CAs Heads and external organizations on issues within the scope of the RCC TIOB

5.Financing the activities of the RCC Telecommunications and Infocommunication Operators Board

Financing of activities of the RCC TIOB is carried out in accordance with the "Regulation on the Finances of the Regional Commonwealth in the Field of Communications" and the "Methodology for Calculating the Membership Fees of the RCC Participants Financing the Expenses of the Regional Commonwealth in the Field of Communications".

These Regulations may be amended or supplemented by the decision of the RCC Board of the Communications Administrations Heads on the recommendation of the RCC TIOB or by agreement with it.
