Regulation on the organization of research and development works in the Regional Commonwealth in the field of Communications (as amended by the Decision of the RCC Board of the Communications Administrations Heads of 08.05.2010 №42/9)

General Regulations

Research and development works (R&D) in the RCC are carried out in the interests of all RCC participants, the Coordination Council of the CIS Member-States on Informatization at the RCC (Coordination Council on Informatization), the RCC Electric Communications Operators Board and the RCC Postal Operators Board in order to ensure a coordinated scientific and technical policy of the RCC in the field of communications and informatization at the expense of their membership fees for the conduct of the charter activities of the RCC.

R&D is carried out in accordance with these Regulations, which govern the formation and approval of an R&D plan, a competition for the selection of contractors, financing and acceptance of R&D.

This document is being put in place in place of the "Regulation on the organization of research and development work in the Regional Commonwealth in the field of communications", approved by the Decision of the RCC Board of the CAs Heads №31/5 of June 29th, 2004.

The procedure for the formation and approval of the R&D plans

1.1. The R&D plan is formed by the RCC Executive Committee on the proposals of the RCC participants, the Coordination Council for Informatization, Operator Boards (hereinafter referred to as the participants), as well as in accordance with the targeted decisions of the RCC Board, the Coordination Council on Informatization, RCC Commissions and Operator Boards on the necessity of carrying for specific R&D.

Moreover, the proposals of the participants include all R&D relevant to them, as well as reviewed and selected by them from the proposals of research, design, training and other industry organizations.

1.2. The formation of the R&D plan consists of the following stages:

1.2.1. Participants submit proposals to the RCC Executive Committee for inclusion in the draft R&D plan for the planned year by March 1st of the previous year in the form given in Annex №1.

1.2.2. The RCC Executive Committee summarizes the proposals of the Participants in the thematic areas of R&D within one month.

1.3. Generalized R&D proposals, as a rule, are submitted by the RCC Executive Committee for consideration by the RCC working bodies in the thematic areas supervised by them.

1.4. The RCC working bodies consider the proposals of the Participants and submit a conclusion on the draft plan being formed, including the estimated cost of the work and possible contractors.

1.5. It is allowed for members of the RCC working bodies to consider participants' proposals by correspondence, including in electronic form using an electronic digital signature (EDS).

1.6. Taking into account the recommendations of the RCC working bodies, the RCC Executive Committee summarizes all the proposals and forms a draft R&D plan.

1.7. The draft R&D plan is included as an integral part in the draft List of activities carried out within the framework of the RCC's statutory activities, which is submitted for consideration and approval by the RCC Board.

The draft R&D plan includes:

- names of research and development works, deadlines;
- the content (purpose) of the work;
- overall cost of the work (in total, including the work for the planned year);

1.8. After consideration and approval by the RCC Council of the List of activities carried out within the framework of the RCC's statutory activities, the RCC Executive Committee carries out preparatory work for tenders for R&D.

1.9. The approved List of activities carried out within the framework of the RCC's statutory activities, an integral part of which is the R&D plan, is circulated by the RCC Executive Committee to all Participants.

2.Holding a Competition

2.1. The purpose of the competition is the selection of performers for R&D on the topics included in the List of activities carried out within the framework of the RCC's statutory activities, approved by the RCC Board.

2.2. The competition is held in accordance with the "Procedure for organizing and conducting a competition for R&D in the RCC" (Annex №2).

2.3. The decision of the Competition Committee is the basis for concluding an agreement between the RCC Executive Committee and the winner of the competition.

3.Technical Task

3.1. When forming the draft R&D Plan, the RCC Executive Committee organizes the development of technical tasks for R&D included in the draft Plan.

3.2. The technical task for R&D is specified by the winner of the Competition, and agreed, as a rule, by correspondence with the RCC Working/Working Bodies, in whose/which competence is the subject of R&D and approved by the RCC Executive Committee.

4. Financing R&D and conclusion of contracts

4.1. R&D financing is carried out at the expense of membership fees for the statutory activities of the RCC in accordance with the “Regulation on the RCC Finance” approved by the RCC Board of the CAs Heads (Decision №38/12 of 12.11.2007).

4.2. All RCC participants, the Coordination Council for Informatization and the RCC Operator Board participate in the financing of R&D.

4.3. The size of membership dues of the participants of the RCC, the Coordination Council for Informatization and the Operators Board of the RCC, in the part allocated for financing R&D, shall be calculated according to the specific gravities of the contributions used in determining the contributions for the maintenance of the RCC Executive Committee, as well as for other activities within the framework of the charter activities of the RCC.

4.4. Voluntary increase in established membership fees for the RCC's statutory activities is allowed in the part allocated for R&D financing in the RCC.

4.5. Contracts with the work executors are concluded by the RCC Executive Committee.

5. Monitoring and accepting R&D

5.1. Monitoring of R&D is carried out by the RCC Executive Committee.

5.2. Upon completion of the stage or all work, the Contractor submits to the RCC Executive Committee the number of sets of the report on the work performed, as agreed upon by the terms of the contract, including on an electronic information carrier.

5.3. Reporting documentation on the results of R&D (in total or stage), draft regulatory documents developed in accordance with the Agreement and the Terms of Reference, must meet the requirements of regulatory acts of the host country - the RCC Executive Committee. Reporting documentation in paper and electronic form is presented in Russian.

5.4. Acceptance of R&D stages and work as a whole is carried out by the RCC Working Bodies (acceptance by correspondence is possible) and the RCC Executive Committee.

5.5. In the event that the results of the work are recognized as meeting the established requirements, the RCC Executive Committee shall sign the Act of Work Acceptance

5.6. R&D results are the property of RCC.

5.7. Information on the results of completed R&D (stages) by the RCC Executive Committee is sent to all participants of the RCC, the Coordination Council of the CIS Member-States on informatization at the RCC, as well as to the participants of the RCC Operator Boards on the relevant topics.

5.8. Implementation of the developed scientific and technical products is carried out by the participants.

6. Disputes Settlement

6.1. All contentious issues arising in the process of implementation and implementation of R&D are considered by the RCC Executive Committee together with the Participants.

6.2. If the parties do not reach agreement on controversial issues, the resolution of such issues may be referred to the court in accordance with the legislation of the host country of the customer, the RCC Executive Committee.

THE ORDER of organizing and conducting a competition for R&D in the RCC

Annex №2 
to the Regulations on the organization of the R&D in the Regional Commonwealth in the Field of Communications

1.General Regulations

1.1. The competition for research and development (R&D) in the RCC is held to determine the Contractor, improve the scientific and technical level and quality of research and work, as well as ensure the efficient use of financial resources of the RCC participants, the Coordination Council for Informatization, the RCC Electric Communications Operators Board and the RCC Postal Operators Board (hereinafter referred to as the Participants) on the basis of creating a competitive environment among organizations - potential R&D executors.

1.2. The main principles of organizing and conducting the competition are the creation of equal starting conditions for all potential performers, publicity, unity of requirements and objectivity in evaluating the proposals of the participants of the competition.

1.3. A legal entity regardless of the form of ownership and departmental affiliation, which has confirmed its scientific and professional potential, experience, positive reputation, availability of necessary labor resources and material and technical base, can be a participant in the competition.

1.4. The competition is organized by the RCC Executive Committee, which ensures the issuance of tender documentation, reception and registration of tender applications, ensures their storage, provides organizational support for the activities of the Competition Commission.

1.5. The competition is carried out by the RCC Competition Commission. In its activities, the Competition Commission is guided by the "Regulation on the Organization of Research and Development in the Regional Commonwealth in the field of Communications" and the annexes to this document.

1.6. The composition of the RCC Competition Commission is composed of representatives of the RCC Working Bodies and divisions of the RCC Executive Committee according to the affiliation of the declared R&D.

The staff of the Competition Commissions is formed by the RCC Executive Committee within two months after the approval of the List of activities carried out within the framework of the RCC's statutory activities, including the R&D plan.

The Chairman of the Competition Commissions is elected from among its members.

The functions of the Secretary of the Competition Commission are carried out by the representative of the RCC Executive Committee, whose competence is to support R&D on this topic.

1.7. To develop an informed opinion, the Tender Committee may conduct an examination of applications. Independent expert organizations or individual experts may be involved in the examination.

2. Subject of the competition

2.1. The subject of the competition is the right to conclude an agreement on the research and (or) experimental design work of the Regional Commonwealth in the field of Communications, which is included in the List of events carried out within the framework of the RCC's statutory activities approved by the RCC Board.

3.Type of the Competition

3.1. The RCC Executive Committee organizes an open one-stage competition.

3.2. An open one-stage competition is held among an unlimited circle of potential participants.

4. Financial Sources

4.1. Sources of financing of competitive research and development are membership fees of the participants for the conductions of the RCC's statutory activities.

5. Requirements for the competition participants

5.1. A participant in the competition for the selection of R&D performers may be the performer:

- in the constituent documents of which scientific and (or) scientific and technical activity is provided;

- who has submitted an application for participation in the tender and registered with the RCC Executive Committee within the time period specified by the Tender documentation;

- having the production capacity, equipment and labor resources necessary to fulfill the contract for the implementation of R&D.

5.2. The competition participant must not:

- have overdue debts on payments to budgets of all levels and state extra-budgetary funds;

- be insolvent (bankrupt);

- be in the process of liquidation or be subject to it in accordance with the requirements of the law.

The property of the tender participant necessary for the fulfillment of the relevant contract should not be under judicial control, any court or person appointed by the court should not manage its affairs, its commercial activities should not be suspended (revocation of licenses, etc.), should not be the subject of legal proceedings.

5.3. A bidder who does not have his own capabilities and qualifications to perform all work on the claimed work as a whole, may involve subcontractors in the execution of a certain amount of work. The tender participant is entitled to involve only those subcontractors that fulfill the requirements specified in clauses 5.1.-5.2. At the same time, the responsibility for the compliance of the attracted subcontractors with the requirements lies with the bidder. The list of subcontractors should be reflected in the tender application.

6. Announcement of the competition

6.1. The basis for the announcement of the Competition is the Decision of the RCC Board on approval of the List of activities carried out within the framework of the RCC's statutory activities, including the R&D plan.

6.2. Information about the competition is communicated to interested enterprises and organizations (potential performers) through the media in the form of a notice published in the media of states whose communications administrations are participants of the RCC (Annex №3).

At the same time, on the RCC website (www.rcc.org.ru) the conditions for the competition (tender documentation) are posted including:

General information about the competition (the official name and type of competition, the organizer of the competition, the subject of the competition, terms of reference for R&D, funding sources, the marginal cost of R&D, the venue of the competition, the timing of the competition, special conditions);

Requirements for bidders and documents to be submitted;

The order of the competition;

Clarifications on the design of tenders.

6.3. Tender documentation on the basis of an approximate form (Annex №4) is formed by the Competition Commission in conjunction with the RCC Executive Committee.

7.Submission of applications for participation in the competition

7.1. Tenders are prepared in accordance with the requirements of the tender documentation.

7.2. Tender applications with a set of attached documents and a cover letter marked "For Competition" are sent to the RCC Executive Committee by mail (registered mail) or delivered to the RCC Executive Committee personally by the representative of the applicant organization in the prescribed form (Annex №5).

The cover letter signed by the head of the applicant organization must contain official confirmation of the consent of all co-contractors declared by the applicant to participate in the work on the proposed conditions. Without such consent, the application of the participant is not considered.

7.3. The following applications are attached to the application:

Qualification form of the tender participant (Annex №6);
Notarized copies of constituent documents;
Extract from the state register of legal entities issued at the place
registration of a legal entity no earlier than 30 days before the deadline for filing applications for participation in this competition;

Copies of licenses to carry out activities subject to licensing, if necessary for the execution of the contract for the declared work, certified by the authority that issued the specified documents, or notarized copies of these documents.
Certificate of tax authorities at the place of registration of the tender participant, confirming the absence of arrears in payments to budgets of all levels and state extra-budgetary funds, issued no earlier than 30 days before the deadline for submitting applications for participation in this tender.
Explanatory note substantiating the proposed solutions, the cost of work and the compliance of these decisions with the statement of work.
7.4. The applicant must prepare and submit the original and one copy of the tender, indicating on each copy, respectively, “Original of the tender” and “Copy of the tender”.

7.5. The tender application prepared by the participant, as well as all correspondence associated with it, are compiled in Russian. Copies of documents drawn up in a foreign language must be accompanied by duly certified translations into Russian Language.

7.6. Prices in the tender application are indicated in Russian Rubles or freely convertible currency (US dollars, euros) at the exchange rate of the Central Bank of the Russian Federation on the day the application is prepared.

7.7. The tender participant is not entitled to change his application for participation in the tender received and registered by the tender organizer, with the exception of cases when the tender organizer makes changes to the tender documentation.

8. The tender procedure

8.1. The procedure, terms and conditions of the competition for the right to perform R&D of the RCC funded from membership fees for its RCC Statuary Activities are determined by the present procedure and tender documentation.

8.2. The order of competition, reflected in the tender documentation includes:

Terms of information exchange between the organizer and participants of the contest;
Procedure for explaining the provisions of the tender documentation;
Procedure for making changes to the tender documentation;
The conditions for the extension of applications;
Conditions for submission and acceptance of applications;
Modification and withdrawal of applications;
Procedure and conditions for opening applications;
Review, evaluation and comparison of applications for participation in the competition;
Rejection of applications;
Determining the winner of the competition;
Publication of competition results;
Terms of confidentiality;
Procedure for concluding a contract with the winner of the competition

9. The timeframe of the competition

10. Competition Results

10.1. The tender commission, in accordance with the terms of the tender documentation, reviews and evaluates tender applications, determines the winner of the tender based on the evaluation criteria. The criteria and their specific gravities necessary for an objective assessment of the proposals of the applicants are determined by the Tender Commission in the preparation of Tender documentation for each R&D.

10.2. When considering competitive applications, first of all, the organization’s ability to carry out certain activities is checked by evaluating its professional experience, financial, personnel and other capabilities and resources necessary for performing R&D.

10.3. The system of criteria for assessing the organization’s ability to perform R&D includes assessments of:
the applicant’s general work experience;
the special experience of the applicant;
experience and qualifications of key employees who will be involved in the project;
the financial condition of the applicant;
applicant's material and technical resources.

10.4. After determining the organizations - applicants that are able to perform competitive R&D, the Tender Committee determines the winner of the tender based on the following main criteria:
degree of compliance with the basic technical requirements for scientific and technical products;
the proposed project development price;
terms of R&D;
economic efficiency of the expected results.

10.5. The winner is the participant who submitted the application with the best working conditions.

10.6. Decisions of the Tender Commission are taken in closed session and approved by an open vote of the members of the Commission by a simple majority of votes. If the votes are equal, the vote of the Chairman of the Tender Commission is decisive.

10.7. The minutes of the Tender Commission "On the results of the Tender" shall indicate the winner and all the essential conditions under which he undertook to perform the work. The protocol is signed by the chairman of the meeting and the secretary of the Tender Commission.

10.8. The decision of the Tender Commission is the basis for concluding an agreement between the RCC Executive Committee and the winner of the competition for R&D.

10.9. The results of the competition, including the name of the winner of the competition, the prices of R&D performance are published on the RCC website and in the media of the RCC members.
10.10. If, after the announcement of the winner of the competition, the Executive Committee of the RCC will become aware of the fact that the winner does not meet the requirements for the participants of the competition established by the Tender Commission, the winner's application for participation in the competition is rejected, and the new winner of the competition is determined in accordance with the tender documentation from among the remaining participants of the competition, the validity period of applications which did not expire.

10.11. The contract is concluded (signed) by the parties no later than 30 days from the day of the tender - the day the winner of the tender is determined.

10.12. If at the time of accepting applications one applicant is registered or only one applicant's proposal remains, the Tender Commission decides to conclude an R&D contract with the indicated applicant if he meets the criteria.
